The agreement
By using redmonk.in or engaging Redmonk Studios Pvt. Ltd. (“Redmonk”, “we”, “us”) for services, you (“you”) agree to these terms. If you don’t, please don’t use the site or engage us.
For paid engagements, the signed Statement of Work (SOW) takes precedence over anything written here.
Acceptable use
You agree not to:
- Scrape, mirror or republish the site or its content without written permission.
- Use the site to harass, defraud or impersonate anyone.
- Attempt to break, probe or stress-test our infrastructure outside a coordinated security test.
- Train machine-learning models on the site’s content without a written licence.
Intellectual property
Our work
The Redmonk wordmark, logo, site design and journal articles are © Redmonk Studios. Excerpting up to ~150 words for review or commentary, with a link back, is fine.
Client work
Final deliverables transfer to the client upon full payment, per the SOW. We retain rights to underlying tooling, internal libraries and the right to show the work in our portfolio (subject to any NDA).
Client engagements
All engagements run on a written SOW that specifies scope, deliverables, schedule, fee and assumptions. The SOW is the binding document.
Out-of-scope work is handled via a Change Request, signed by both sides before work begins.
Payment
- Invoices are issued at SOW kickoff and at agreed milestones.
- Net 14 days from invoice date, unless the SOW says otherwise.
- Late payments accrue interest at 1.5% per month, capped at 18% annually.
- Indian clients are billed in INR with applicable GST. International clients are billed in USD/EUR.
Warranties & disclaimers
We warrant that engagement deliverables conform substantively to the SOW. Beyond that, the site and any free resources are provided as-is, without warranty of any kind, express or implied.
We don’t warrant that the site will be uninterrupted, error-free, or that the journal advice will fit your specific situation.
Limitation of liability
To the fullest extent permitted by Indian law, our total aggregate liability for any claim arising out of an engagement is capped at the fees paid to Redmonk under the relevant SOW in the 12 months before the claim arose.
Neither party is liable for indirect, consequential, incidental or special damages — including lost profits or lost data — even if advised of the possibility.
Termination
Either party can terminate an SOW for material breach with 14 days’ written notice and a chance to cure. Either party can terminate without cause with 30 days’ notice; you pay for work already done plus any non-refundable commitments.
Survival: sections on IP, confidentiality, payment and limitation of liability survive termination.
Governing law
These terms are governed by the laws of India. Disputes will first be discussed in good faith for 30 days, then submitted to mediation in Bengaluru, then — if unresolved — to the exclusive jurisdiction of the courts of Bengaluru, Karnataka.
